Imposição do estado quanto a educação institucionalizada e poder familiar: Limite de atuação das duas esferas

Abstract

The objective of this scientific article is to trace an analysis about homeschooling, showing its trajectory over the years, as well as the context of its applicability in Brazilian territory. In this last aspect, we sought to situate the roles and spheres of action of the family and the State. The analysis was carried out in the light of the constitutional text, the Civil Code and pertinent legislation, as well as, of indoctrinators. The investigation has an analytical character and aims to demystify some understandings that permeate the educational environment, such as the idea that education must be institutionalized. The specific objectives of this work gravitated around social themes: such as the role of the family, role of the State, education homeschooling, always with the scope of guiding new understandings on the issue, marked by the theoretical cuttings that we currently have. It is an opportunity to revisit the history of this movement for the right to homeschooling in Brazil and to establish a counterpoint with the national legislation. The theoretical framework was guided by the contributions of jurists and thinkers in the field of education, collected in literary works and published digital materials. This information was at the heart of a discussion that was being shaped and giving body to the article. Currently, there is an increasing number of families in Brazil that have opted for the adoption of homeschooling, although outside the norm, which, in a way, invites a more detailed reflection on the theme. The methodology applied was that of bibliographic research.
